BRWAIZZ confirms that it follows and operates in accordance with all applicable Meta Platforms, Inc. policies, including Facebook and Instagram Community Standards, Advertising Policies, and related guidelines while delivering its services.
2. Services
We provide social media management services, including but not limited to content creation, scheduling, account management, advertising support, analytics, and consultation. The exact scope of services will be defined in a separate agreement, proposal, or package selected by the client.
3. Eligibility
By using our services, you confirm that: - You are at least 18 years of age. - You have the legal authority to enter into this agreement. - Any information you provide is accurate and complete.
4. Client Responsibilities
The client agrees to: - Provide accurate login credentials, brand assets, and required information in a timely manner. - Ensure that all content provided or approved by the client complies with applicable laws and platform policies. - Take full responsibility for the legality and originality of the content.
5. Content Ownership
- All original content created by us remains our intellectual property until full payment is received.
- Upon full payment, ownership of the content is transferred to the client unless otherwise agreed in writing.
- We reserve the right to showcase completed work in our portfolio unless the client requests confidentiality in writing.
6. Payments and Fees
- All fees are communicated in advance and must be paid as per the agreed schedule.
- Payments once made are non-refundable unless otherwise stated.
- Delayed payments may result in suspension or termination of services.
7. Revisions and Approvals
- A limited number of revisions are included as per the selected plan.
- Additional revisions may be charged separately.
- Client approval is required before publishing any content.
8. Third-Party Platforms
We are not affiliated with Facebook, Instagram, Meta Platforms, X (Twitter), LinkedIn, Google, or any other third-party platform. The client agrees that: - Platform downtimes, algorithm changes, policy updates, content removal, reach limitations, account restrictions, or suspensions are beyond our control. - We are not responsible for actions taken by Meta or any other platform against accounts or content.
8A. Compliance With Meta (Facebook & Instagram) Policies
The client acknowledges and agrees that all services provided by us shall strictly comply with Meta Platforms, Inc. policies, including but not limited to: - Meta Community Standards - Meta Advertising Policies - Meta Political Ads & Election Integrity Policies - Meta Pages, Groups, and Accounts Policies
The client confirms that: - They are the lawful owner or authorized administrator of the social media accounts provided. - All content (text, images, videos, logos, claims, and links) complies with Meta policies and applicable laws. - No content will include impersonation, misleading identity, fake engagement, prohibited political manipulation, hate speech, or restricted content.
We reserve the right to refuse, pause, edit, or remove any content that may violate Meta policies or place accounts at risk, without liability.
Any penalties, restrictions, or bans imposed by Meta due to policy violations shall be the sole responsibility of the client.
9. Prohibited Use
You agree not to use our services for: - Illegal, misleading, or deceptive activities. - Hate speech, harassment, or explicit content. - Violation of intellectual property rights. - Any activity that violates social media platform policies.
10. Account Suspension or Termination
We reserve the right to suspend or terminate services if: - These terms are violated. - Payments are not made on time. - The client engages in unlawful or unethical practices.
11. Limitation of Liability
To the maximum extent permitted by law: - We are not liable for indirect, incidental, or consequential damages. - We do not guarantee specific growth, reach, engagement, or sales results.
12. Indemnification
The client agrees to indemnify and hold us harmless from any claims, damages, or losses arising from: - Client-provided content. - Violation of laws or platform policies. - Misuse of our services.
13. Confidentiality
Both parties agree to keep confidential any sensitive or proprietary information shared during the course of service.
14. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. Continued use of the website after changes indicates acceptance of the revised terms.
15. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.
